This morning the Commonwealth Secretary of the state of Pennsylvania and the State Attorney General (AG) filed a lawsuit seeking an injunction to stop the Center for Individual Freedom (CFIF) from airing its television ad in Pennsylvania.
CFIF argued that its activities are in full compliance with state law, including a stipulated judgment reached with the AG in a federal lawsuit the organization initiated to seek an interpretation of the law prior to commencing protected free speech activity in Pennsylvania. That stipulated judgment, signed by a federal district judge, acknowledged the constitutional right of CFIF to air issue ads that don't expressly advocate the election or defeat of a candidate for office.
On Friday evening, the Commonwealth Court of Pennsylvania in Harrisburg rule in CFIF's favor, denying the state's request for an injunction.
