Why Medical Malpractice Reform Must Be a Part of Real Health Care Reform

Last week, President Obama hosted the White House Forum on Health Reform and declared that the economic crisis in this country has turned health reform into an imperative. “The status quo is the one option that is not on the table,” he said. “And those who seek to block any reform at any cost will not prevail this time around.”

With President Obama now insisting on health care reform, industry experts are calling on the Administration to consider all sides of the issue. Recently, Robert M. Wah, M.D., board member of the American Medical Association, suggested that medical tort reform could solve some of the problems with the failing health care system, noting that medical tort reform does not cost taxpayers a dime and will actually save money on defensive medicine costs and decrease the amount that taxpayers pay for malpractice insurance for medical schools and state-run hospitals.

Dr. Wah isn’t the only one advocating such reform. In a Memorandum entitled “Promoting the General Welfare Through Civil Justice Reform,” The Heritage Foundation recently called on the president to “support medical liability reform while respecting the role of the states” and to work in coordination with Congress “to achieve the goal of promoting a legal system that is not unnecessarily punitive and is both fair and just to all parties.”

Recently, Hans von Spakovsky, a Visiting Legal Scholar at The Heritage Foundation, joined CFIF’s Renee Giachino to discuss the Memorandum and why the Obama Administration must advance the cause of legal reform.
