The history of government price-control policies that seek to impose price ceilings on goods and services is both long and replete with failure. That’s because price controls discourage innovation and investment, and lead to shortages in the marketplace, among other unintended consequences.

No targeted industry is immune from the predictable negative impacts of prices controls – not even prescription drugs, which seem to be a primary target in the price-control crosshairs of policymakers at all levels of government.

CON laws ‘represent one of the worst’ anti-competitive healthcare regulations.

NASHVILLE, TN – Today, the Center for Individual Freedom (CFIF) launched a new advertisement calling for full repeal of Tennessee’s Certificate of Need (CON) laws. The ad highlights the Trump administration’s prior support for repealing these harmful laws in states like Tennessee where they still exist. 

“President Trump’s administration urged repeal of state CON laws because it understood CON laws reduce access to affordable care, limit patient choice, and increase healthcare costs,” said CFIF President Jeff Mazzella. “In fact, the Trump administration stated CON laws ‘represent one of the worst’ of states’ anti-competitive healthcare regulations.” 

Despite productive reforms passed last session, Tennessee’s remaining CON laws continue to reduce access to affordable, high-quality care across the state, where support for full CON repeal is strong.  Indeed, Tennessee patients and their families sent tens of thousands of letters urging their representatives to take legislative action to fully repeal the state’s CON law during the 113th General Assembly. 

“The Trump administration was right. CON laws have failed miserably at controlling costs, improving quality, and increasing access to care. As Tennessee’s General Assembly convenes its new session, the state’s strong conservative leaders should finish the job by fully repealing the state’s remaining CON requirements,” Mazzella concluded.
