We’re just over a month into the October 2008 Term of the United States Supreme Court and already the Court has heard oral arguments in some of the biggest cases of this term.
Last week, the doctrine of federal preemption was the subject of debate in what is hailed as the biggest business law case this term, Wyeth v. Levine, with the validity of our nation’s labeling laws coming under scrutiny. This week, oral arguments surrounded the First Amendment in both FCC v. Fox Television Stations, which tests the meaning of “indecent” under our broadcasting laws and whether the FCC can fine broadcasting stations for “fleeting expletives,” and Pleasant Grove City v. Summum, which draws the boundaries of government speech versus private speech, with a decision that could threaten long-standing and well-established patriotic, religious and historical displays.
Recently, CFIF Director of Legal and Public Affairs Timothy Lee joined Renee Giachino, CFIF’s Corporate Counsel and Senior Vice President, to discuss the SCOTUS October 2008 Term, the interesting cases already announced for consideration, and some cases still pending grant or denial of certiorari.
